Photo by Bruce Matlock / bmatlock@statesville.com

A forensic psychologist testified Thursday that a Mooresville woman could not form the intent to kill when she shot her off-duty police officer husband in 2005.

If Misty was a socially isolated a stay-at home mother then where did such a large amount of money go to?
Misty why didn't you just get a job? Why didn't you just go to your family for financial help?
Why Misty? May our God have mercy on your soul!

Slaying unintentional?

How do you see her not being capable, when she has lied and stole over the years and from her own church? She knew what kind of financial bind she CONTINUED to put her family in. She thought this would solve everything. Her family making comments she seemed a little distance from everyone just before the shooting....maybe she had a touch of what they call a conscience. UNBELIEVABLE!!!

Our guess is that she wasn't experiencing guilt(see last post: Slaying Unintentional?) but rather anger at her shopping sprees being ended by her husband-the same anger that eventually caused her to kill him. Nothing real complicated here-he told her no more and she went into a rage and shot him.
There are plenty of case histories of people with personality disorder doing similar crimes. A common trait is that endear people to their cause and are quite believable.

This guy is an idiot! Misty is a pathological liar, so she can make you believe anything. She meant to kill Quinn. If she was thinking of sucicide then why didn't she take her own USELESS life instead of such a wonderful persons? We will never know why. I just hope those jurors are smart enough to see the truth. What a bunch of lies this whole case has been full of.

Misty's mom you are just a dumb as everyone else. I have kids and still can't see how ya'll believe her LIES, LIES, LIES!!!

Get a dang job! That is the answer to money! Quit spending what you don't have. Maybe you should have raised her better!!!

Now that the views of these grandparents who have custody have been heard, What about the children? I'm not sure how the whole social security thing works but does Frances & Bobby have to be accountable for this money? And if so who moniters this?

I am a little confused at what you are referring to bonnie about swaying the jury? The fact that a lot of officers are coming up there on our days off? Not being payed for it. At least we are not calling the news people to come film us as we come in and leave. Sound familiar? Bobby did this with the children. Talk about exploitation of a child. We sit in the room and relive the death just like everyone else. Some of us don't want to but are compelled to because there is no voice anymore for him but us and the DA.

As I sat in the closing arguments today I was sickened as the defense did his job at pointing blame at everyone else but Misty. She was an unfortunate victim of an accident. DA Martin drove the nail home in pointing out how convenient her lies came to her and the progression of change.

You may not deal with people that deceive you in your life. Lucky you. There are those of us that deal with it everyday. The deception of Misty was evident early on to us. What stings us to our very souls is the parents treating us like we killed him.

I just wish people would take God out of the equation for now. This trial is of this earth. We are dealing with human laws and our society. Like it or not that is how it is. What ever religion you are or are not. If you do believe then you know that punishment is yet to come.

I watched Francis turn her nose and make nasty remarks as we (the officers) walked out during breaks. Especially those that first she praised for their kindness and willingness to treat those children as their own family. I probably will not get you to understand that we do see each other as family. Often much more close than blood.

It is often joked you can pick your friends but not your family.

Mr. Jennings did his job. He blamed Quinn and the MPD detectives. That is what he does for a living. We argue our side for a living.

I know personally that he taught her about guns. Probably why Jennings did not put me on the stand after he subpoenaed me and several others at CPD. He then sequestored us out of the court to keep us from hearing the ridiculous string of lies she has woven and spun.

You know what happens when you spin a bunch of string together tightly? You make a rope. You know what happens when you make your own rope and wind it around enough? You make a noose.

If given the opportunity I would love to see her hang from it but that is not an option here. Whatever is decided is just that.

In discussing the children. Why is that a question. They do now have something they would not have from them. A chance at a college education. Quinn put what little he could afford back for it and we finished it off for him.

But I'll be damned if any one of the adults will ever see a penny of it. It is for Quinn's kids to have a future. Domething Misty had not intention of giving them.

I'm not up to fighting with you all tonight but will answer the bottom question, yes the grandparents do have to submit a report to social security annually showing what the money was used for. I had to when my child got survivor benefits.

They have taken good care of those children and its sad that at their age they will be raising them if Misty goes to jail, but the love they have for those babies is undeniable and the children for them.

After watching the closing statements today, I was disturbed by the noticable absence of Bobby and Francis during the Prosucution's closing.

Bobby at the funeral home you said to me "I just want the truth".

Sabrina in your statement written by Misty's lawyer that you read to channel 9, you mentioned wanting the truth to come out.

Now 12 of Misty's peers will decide what the truth is. They get to decide it based on fact and evidence.

I will say this to the entire Witherspoon family, I admire your trust and faith and beliefs, the same way I admire an Islamic extremist who blows himself up for his cause and faith. Sometimes you need to open your eyes and think for yourself. In the matter of your son, brother and inlaw, dont be sheep and follow Misty blindly. Talk about what you have seen at the court house the last 3 weeks.

I miss my friend and no matter what the outcome, I will not get to see him on this earth again because of Misty. Quinn take care of my dogs till I get there.

I am very disappointed that you didn't chose to publish the comment I left about the money that we, at the Quinn Witherspoon Memorial Fund, have raised for Quinn's kids. I was trying to make sure that everyone understood that that money was safe and secure and was raised for the children and not Misty's defense.

Kudos to the Prosecution. What an absolutely awesome job!!! Congratulations to ADA Greg Brown and Alan Martin on the best closing argument I have ever heard. Their close was better than any fiction show (about courtrooms) on TV. Their points were factual, truthful and poignant at the same time. A story....A story....I'll say!!!!

Mr. Childers, I'm sorry I wasn't ignoring your post. It wasn't there when I made mine. Is there some way you and I can discuss this more? I know you can't say anything publicly until the trial is over but I would like to sit down and talk to you when this is over. I'd really like to hear what you have to say and am willing to listen.

Bonnie, It is none of your buisness what is going on with this so there is no reason for you to talk to the detective. I am a family member and I think you have injoyed this blog a little too much. Pray for the family or do whatever but this really is none of your buisness. Everyone else has made there statements and moved on. You are one of the only people that just can't leave it alone. Move on because it really doesn't matter what is said, wether it was an accident or not, everyone has there own opionion. And yes I am anonymous just incase you have to remind me in your next post.

I know the Witherspoon family and I also knew Quinn well. We went out on a few dates in high school, he is the most outstanding peron Ive every known. I want to remember all the good things Quinn has done in life and not drag his name down with his family. Only god,Quinn and Misty really knows what happen and reguardless of what Quinn's family thinks or wants to support, hopefully the courts system will do their job well. I still to this day cannot beleive he is gone and what this has done to our community and life around us. I do not understand why things happen this way and how the Witherspoon go living day to day. It's so heartbreaking, Ive known this family forever and I went to church with this family, but to this day I have mixed feelings on how this happened. I find it hard to face them when I see them out in public. I just hate those kids have to go thru this, they dont deserve it. Quinn does not deserve it. Please I hope the system comes to justice and let him rest!!!!!!!!!!!!!
